BabyReco LLC ("we", "our", or "us") is committed to protecting your privacy. This Privacy Policy explains how we handle your information when you use our mobile application ("the Application").

Please read this Privacy Policy carefully. By accessing or using the Application, you acknowledge that you have read, understood, and agree to be bound by all terms of this Privacy Policy. If you do not agree with our policies and practices, please do not use our Service.

Changes to This Privacy Policy

We reserve the right to modify this Privacy Policy at any time by posting updates on this page. Please check the "Effective as of" date above to determine if the Privacy Policy has been revised since your last visit.

All information collected and maintained by us is subject to the version of the Privacy Policy in effect at the time of collection. If the Privacy Policy changes in any material way, we will not use previously collected data in a manner inconsistent with the version in effect at the time of collection, without your prior consent.

Information Collection and Use

We do not sell or rent personal data. We may share pseudonymized technical and device information with service providers for analytics, attribution, and advertising measurement as described below.

We collect and process information to provide, maintain, and continuously improve the functionality, accuracy, and reliability of the Application. All collected data is handled securely and used only for the purposes described below:

• To provide and maintain the Application, ensuring that it functions correctly and reliably.
• To improve and personalize the Application, enhancing features, user experience, and the accuracy of our algorithms.
• To perform analytics and research, including evaluating app usage, tracking errors, identifying trends, attribution, and advertising measurement where permitted.
• To process and support in-app purchases and related transactions.

1. Data collected and stored by BabyReco LLC

Certain types of data are transmitted securely to our servers and processed only by BabyReco LLC. This information is never shared with any third parties and is used exclusively to improve our cry recognition technology and the overall app experience.

We collect and process the following categories of information:

• Information about your baby, such as date of birth and gender, if you choose to provide it. This information helps improve the accuracy of the analysis and adapt it to your baby’s developmental stage.
• Audio recordings of your baby’s crying. Recordings are transmitted securely to our servers and used only to expand our internal database of cry sounds and to train and improve our artificial intelligence models.
• Aggregated cry analysis data, such as acoustic features, sound patterns, and model confidence levels. This data is used only for algorithm development and quality improvement.

Information stored by BabyReco is handled without direct identifiers and is not linked by us to a specific user, device, or account. Uploaded recordings are stored securely and are never shared or used for any purpose other than improving our recognition technology. Because recordings are not linked to an identifiable user or account, we may be unable to locate or delete a specific recording in response to an individual request.

2. Data collected by third-party service providers

To improve the Application’s functionality, relevance, and user experience, we automatically collect certain pseudonymized technical and behavioral information. While this information does not directly identify you, it may be linked to your device or app instance identifier and therefore constitutes pseudonymized personal data. This data is transmitted to and processed by us or our third-party service providers:

• Firebase
• Adapty
• Amplitude

We collect the following categories of data:

• Technical details (e.g., mobile operating system and device model, app-instance identifiers, device identifiers such as IDFA on iOS, when permitted by the user, country and time zone)
• App usage patterns (e.g., pages and screens viewed, session duration, interaction flows, crash logs, and error reports)
• Performance and debugging information (e.g., feature usage, loading times, app responsiveness)

This data helps us understand user behavior, diagnose technical issues, improve the quality of the Application, and, where permitted, measure attribution and advertising performance. It does not include any baby information or audio recordings. Where advertising or attribution integrations are enabled, third-party service providers may further process or transmit relevant identifiers and events to advertising or attribution platforms. Their processing is governed by their own privacy policies and applicable data protection requirements.

Legal Basis for Processing (GDPR Specific)

For users located in the European Union and the United Kingdom, BabyReco LLC processes personal and pseudonymized data in compliance with the General Data Protection Regulation (GDPR) and the UK GDPR.

We rely on the following legal bases for processing:

• Consent. We process audio recordings of a baby’s crying and related information (such as date of birth and gender) only with your explicit consent. On iOS, where required, we also rely on consent to access and use advertising identifiers such as IDFA for attribution and advertising measurement. IDFA is accessed only when permitted by the user through Apple’s App Tracking Transparency framework. You can withdraw your consent at any time through the Application settings, applicable device settings, or by contacting us. Withdrawal of consent will not affect the lawfulness of processing carried out before withdrawal.
• Legitimate Interests. We process pseudonymized technical and usage data (such as device type, operating system, and interaction data) to ensure the proper functioning, security, and continuous improvement of the Application. We only do so where our legitimate interests are not overridden by your rights and freedoms under data protection law.
• Contractual Necessity. We process certain information as necessary to provide and maintain the core features of the Application, including functionality related to subscription management, data synchronization, and personalized user experience.

Advertising identifiers are used only for the purposes described above and only where permitted.

Disclosure of Your Information

We do not sell your personal data. We disclose the information we collect (pseudonymized data) only in the following situations:

1. Third-Party Service Providers:

The Application uses third-party services to enhance functionality, improve user experience, analyze usage patterns, support in-app purchases, and, where enabled, support attribution and advertising measurement. Their processing is governed by their own privacy policies and applicable agreements.

2. Legal Requirements and Protection of Our Rights:

We disclose the pseudonymized data we collect only if we have a good-faith belief that such disclosure is reasonably necessary to comply with applicable law, regulation, legal process, or enforceable governmental request. This also includes cases where we believe it's necessary to identify, contact, or take legal action against individuals who may be violating this Privacy Policy or our terms of service, or to protect the safety and rights of our users and the general public.

International Data Transfers

Your pseudonymized data (the data we collect) may be transferred to and processed in countries other than your country of residence, including the United States, where some of our service providers' servers are located. These countries may have data protection laws that are different from those in your country.

For transfers of personal data from the European Economic Area (EEA) and the United Kingdom, we ensure that such transfers are protected by appropriate safeguards as required by the General Data Protection Regulation (GDPR) and UK GDPR. These safeguards typically include the use of Standard Contractual Clauses (SCCs) approved by the European Commission, or reliance on the Data Privacy Framework (DPF) for transfers to certified U.S. entities, ensuring a level of data protection equivalent to that in the EEA/UK.

Children’s Privacy

The Application is not directed to children, and we do not knowingly collect personal information directly from children.

Any information related to a child (such as name, age, or gender) is provided voluntarily by the child's parent or caregiver solely for the purpose of using the Application. This data may be processed in pseudonymized form to help improve the Application and enhance the accuracy of cry recognition. No information is used to identify or profile individual children.

The Application is intended for users aged 13 years or older. Additional age or parental-consent requirements may apply depending on the laws of your country or region.

Data Retention Policy

We retain the pseudonymized personal data we collect only for as long as necessary to fulfill the purposes outlined in this Privacy Policy, in accordance with applicable legal and operational requirements.

Specifically:

• BabyReco Server Data: Audio recordings of baby crying and related metadata (such as baby’s age and gender, if provided) are stored securely on our servers for as long as needed to improve and validate our cry recognition algorithms. This data is stored without direct identifiers and is not linked by us to a specific user, device, or account.
• Third-Party Service Provider Data: Technical, analytics, and advertising identifier data processed by Firebase, Amplitude, Adapty, or other service providers is retained in accordance with the applicable provider’s privacy policy and available retention settings.
• Locally Stored Data: Certain information stored on your device (for example, your baby’s name, cry history) remains under your full control and is not transmitted to our servers. This local data can be deleted at any time from within the app or by uninstalling the Application.

Your Data Protection Rights (EU and UK Residents)

If you are a resident of the European Union or the United Kingdom, you have specific rights regarding your personal data under the General Data Protection Regulation (GDPR) or equivalent UK law. Please note that these rights primarily apply to the pseudonymized data we collect and process on our servers. For data which is processed exclusively on your device, you can manage, modify, or delete this data directly within the Application or by deleting the Application from your device.

Your rights (for data we collect) include:

• Right to Access: You have the right to request copies of your personal data that we hold.
• Right to Rectification: You have the right to request that we correct any information you believe is inaccurate or complete information you believe is incomplete.
• Right to Erasure ("Right to be Forgotten"): You have the right to request that we erase your personal data under certain conditions. For pseudonymized data, this might involve requesting deletion of your app instance data by deleting the application or contacting us. Please note our specific data retention periods outlined above.
• Right to Restrict Processing: You have the right to request that we restrict the processing of your personal data under certain conditions.
• Right to Object to Processing: You have the right to object to our processing of your personal data under certain conditions.
• Right to Data Portability: You have the right to request that we transfer the data that we have collected to another organization, or directly to you, under certain conditions.
• Right to Withdraw Consent: Where we rely on your consent to process your personal data, you have the right to withdraw that consent at any time. Tracking permission can also be changed at any time in iOS Settings.

California Residents' Privacy Rights

California residents have additional rights under the California Consumer Privacy Act (CCPA):

• Right to opt out of the sale or sharing of personal information, where applicable. We do not sell personal information.
• Right to non-discrimination for exercising these rights.

Security

Protecting user privacy and the security of your data is a top priority for us. We implement appropriate technical and organizational measures, in line with industry best practices and data protection regulations such as the GDPR and CCPA, to safeguard the pseudonymized data we collect. Access to the data we collect is restricted to authorized personnel, contractors, agents, and third-party service providers who require it for the purposes described in this Privacy Policy. We use password protection, access logs, and system monitoring to help ensure confidentiality and security of the data we handle.

Data Deletion Requests

If you wish for your pseudonymized data associated with your app instance, which we collect, to be removed from our systems, please contact us at contact@babyreco.app.

Upon verifying your request (which may involve confirming your device or app-instance details to the extent possible with pseudonymized data), we will delete the relevant data within a reasonable timeframe, unless we are legally required or otherwise permitted to retain it. Please note that deleting data we collect may affect certain features or the functionality of the Application.

For data processed exclusively on your device, you can delete this data directly through the Application's features or by uninstalling the Application from your device.
