Changes to the Terms

We reserve the right, at our discretion, to update or revise these Terms at any time. We will post such changes on this page, and any additional or revised Terms will become part of the agreement. The updated Terms will take effect immediately upon posting, unless otherwise specified. You should check this page regularly to see if a new version has been posted. If the amended Terms are not acceptable to you, your only recourse is to cease using the Application. Continued use of the Application constitutes your binding acceptance of the updated Terms.

No Medical Advice

The Application is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or medical condition. It is designed solely as an informational and support tool for parents and caregivers of infants.

The Application provides general information and baby care tips based on common knowledge and reputable sources. However, it does not provide medical advice, diagnosis, or treatment, and should not be considered a substitute for consultation with a qualified healthcare professional (such as a pediatrician or family doctor).

Do not delay seeking medical care based on any result or information provided by the Application. If your child appears ill, is in distress, or you are concerned about their health or safety, contact a qualified healthcare professional. In an emergency, contact your local emergency services.

Always seek the advice of a medical professional with any questions you may have regarding your child’s health, development, or well-being.

We strive to ensure that the content provided is accurate, up-to-date, and helpful. However, we do not warrant the completeness, reliability, or applicability of any information in the Application. Reliance on any information provided is at your own risk.

Age Requirements

The Application is intended for individuals aged 13 years or older and is not directed to children. Additional age or parental-consent requirements may apply depending on the laws of your country or region.

If you are under the legal age of majority in your jurisdiction, you must review these Terms with your parent or guardian, who must agree to these Terms on your behalf where required by law.

User Conduct

You agree to use the Application in a lawful, respectful, and responsible manner. You must not:

• Violate any applicable law or regulation;
• Interfere with or disrupt the operation of the Application or any networks connected to it;
• Use the Application for any fraudulent, harmful, or malicious purpose;
• Attempt to gain unauthorized access to any part of the Application, its systems, or data.

Intellectual Property Rights

All content, features, and functionality of the Application (excluding data processed solely on your device, such as your baby’s profile information or cry analysis results) are the property of BabyReco LLC or its licensors and are protected by applicable intellectual property laws.

You may not copy, reproduce, distribute, or exploit any part of the Application, including its interface, design, content, and algorithms, without prior written consent.

An exception applies to the data you input and which is processed on your device, such as your baby's profile (name, age, gender), cry analysis results, which you may copy, store, or share for personal use or in discussions with your healthcare provider.

Disclaimers and Limitation of Liability

The Application is provided to you on an "as is" and "as available" basis, without warranties of any kind, either express or implied. To the fullest extent permissible pursuant to applicable law, BabyReco LLC disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

BabyReco LLC does not warrant that the Application will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We make no warranties or representations regarding the use of the Application or the information provided therein in terms of its correctness, accuracy, reliability, or otherwise. Your use of the Application is solely at your own risk.

You acknowledge and agree that:

• If you use the Application outside a Wi-Fi area, your mobile provider’s charges may apply for data usage or roaming. You are solely responsible for any such charges. If you are not the bill payer for your device, you represent that you have obtained permission from the responsible party.
• We are not responsible for your device’s battery level or power status. If your device runs out of battery and you are unable to use the Application, we cannot be held liable.
• Some features of the Application require an active internet connection (Wi-Fi or mobile data). We are not responsible if the Application does not function fully due to lack of connectivity or data limits.
• While we strive to ensure the Application is accurate and up to date, we do not guarantee it will be free of errors or interruptions. You are responsible for ensuring that the Application functions correctly on your device.

To the fullest extent permitted by applicable law, in no event shall BabyReco LLC be liable for any direct, indirect, incidental, special, consequential, or punitive damages (including, without limitation, damages for loss of profits, data, or goodwill) arising out of or in connection with your access to, use of, or inability to use the Application, or any content or information provided through the Application, whether based on warranty, contract, tort (including negligence), or any other legal theory, even if we have been advised of the possibility of such damages.

Termination

We reserve the right to suspend or terminate your access to the Application where reasonably necessary, including if you violate these Terms, misuse the Application, or where required by law or for security reasons. Termination of access by us does not automatically cancel or refund an active subscription purchased through an app store. Subscription cancellation and refund eligibility are governed by the terms and policies of the applicable app store.

Data Collection and Privacy

Your privacy is important to us.

We do not sell or rent personal data. We may share pseudonymized technical and device information with service providers for analytics, attribution, and advertising measurement as described in our Privacy Policy.

You are responsible for maintaining the security of your device and access to the Application. We strongly discourage jailbreaking or rooting your device, as this may compromise security and result in the Application not functioning properly or at all.

Third-Party Services

The Application may use third-party services (e.g., analytics, performance monitoring, crash reporting, subscriptions). These services are governed by their own terms and privacy policies regarding data collection and processing. Please refer to our Privacy Policy for details.

Apple App Store Terms

You acknowledge and agree that these Terms are concluded between you and BabyReco LLC only, and not with Apple Inc. ("Apple"). BabyReco LLC, not Apple, is solely responsible for the Application and the content thereof. You agree to comply with all applicable third-party terms of agreement when using the Application (e.g., your wireless data service agreement). You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Application. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Application. Apple is not responsible for addressing any claims by you or any third party relating to the Application or your possession and/or use of the Application, including, but not limited to: (i) product liability claims; (ii) any claim that the Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation. Apple is not responsible for the investigation, defense, settlement, and discharge of any third-party claim that your possession and use of the Application infringe that third party’s intellectual property rights. You agree to comply with all applicable terms of agreement when using the Application. Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of the terms and conditions of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

Subscriptions and In-App Purchases

The Application offers auto-renewing subscriptions to unlock full features and content. If you choose to subscribe, you agree to the terms and conditions applicable to that specific subscription. Purchases are processed through the app store from which you obtained the Application, such as Apple’s App Store or Google Play, and are subject to that store’s applicable payment, renewal, cancellation, and refund terms. We do not have access to your payment information.

Important details regarding auto-renewing subscriptions:

• Subscription Renewal: Subscriptions automatically renew unless canceled before the applicable renewal date, subject to the rules of the app store through which the subscription was purchased.
• Cancellation: You can manage or cancel your subscription through your Apple Account subscription settings or Google Play subscription settings, as applicable.
• Effect of Cancellation: You generally retain access to subscription features through the end of the paid subscription period, subject to the applicable app store’s terms.
• Trials and Price Changes: Any trial terms, subscription prices, renewal terms, and applicable notices or consent requirements are presented or handled by the applicable app store in accordance with its rules.

Google Play Terms

If you download the Application or purchase a subscription through Google Play, your purchase, billing, renewal, cancellation, and refund rights are also subject to the applicable Google Play terms and policies. Google is not responsible for the Application itself, its content, or any support provided by BabyReco LLC.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law principles, except to the extent that mandatory laws of your country of residence apply.

If you are a consumer in the European Union or the United Kingdom, you retain the protection of mandatory consumer laws applicable in your country of residence and may bring proceedings in the courts available to you under applicable law. In all other cases, disputes arising from or related to these Terms shall be subject to the jurisdiction of the courts located in Wyoming. To the extent permitted by applicable law, you and BabyReco LLC agree to waive any right to a jury trial.
